LEGAL TERMS AND CONDITIONS EL MILAGRO 3.0 SWEEPSTAKES.

1.- COMPANY ORGANIZING THE PROMOTION

The company LABIENHECHA ESTUDIO SL, on behalf of the brand Labienhecha, hereinafter Labienhecha, with address at Calle Croacia, 14, 29004 - Málaga, and CIF B10708212 organizes for promotional purposes several actions, raffles and draws (hereinafter "the Promotions") to be developed through the Internet, specifically on its website, online store and Instagram, exclusively for users resident in Europe and of legal age in accordance with the provisions of the section on conditions to participate.

2.-STARTING DATE AND ENDING DATE

The Promotion will start on 13-10-25 and will end once THE MIRACLE is closed. Winners will be announced between 5 and 10 days after the closing of the campaign.

*IMPORTANT UPDATE 11/23: our goal was to make the move before Black Friday, but this Miracle is taking longer than expected. As soon as we get it done, THE BIG DRAW WILL BE THE BIG CELEBRATION.

*Labienhecha reserves the right to extend the promotion as it is subordinated to the achievement of the objectives of the MiIagro 3.0 campaign.

3.- REQUIREMENTS, MECHANICS, CONDITIONS AND PRIZES OF THE PROMOTIONS

The participation requirements will be the following:

  • Participation in the sweepstakes is obtained automatically through the purchase of any of the participations in the special crowdfunding El Milagro 3.0.
  • There are 8 products in this crowdfunding. Each one of them grants a specific number of participations in the raffle.

  • THE SHARE NUMBER CORRESPONDS TO THE ORDER NUMBER (STARTS WITH LBHXXXXX)
  • IF YOUR PARTICIPATION PACKAGE HAS MORE THAN 1 PARTICIPATION, NUMBERS ARE ASSIGNED IN ADDITION TO THE ORDER NUMBER. EXAMPLE:

  • As a special promotion, the first 100 orders multiply x2 your share. That is: if you purchase the share with 5 numbers, we multiply them x2 and you get 10.
  • The data or profiles must be data or profiles.
  • Profiles dedicated to sweepstakes are excluded (at the discretion of the organization).
  • Labienhecha is not responsible for the same winner to be awarded several times. in fact, the greater the participation , the greater the number of probability of winning prizes.

The mechanics:

50 winners and 5 alternate/s will be chosen by random draw, totally at random, at theclose of the campaign.

*50 winners = 50 numbers, corresponding to the orders.

The selection of winners and alternates will be done randomly through the Easypromos platform. Easypromos is a platform that guarantees the transparency of the sweepstakes result and, as proof of this, issues a certificate of validity for each of its sweepstakes, whose result is unalterable by the sweepstakes organizer, and which any participating user can request from the organizer.

*If the prize has not been claimed within 15 calendar days, the period is considered over and the substitutes can claim the prize.

*If after another 15 calendar days, there are unclaimed prizes, Labienhecha reserves the right to cancel the prize claim.

*EXTRA BLACK FRIDAY: ALL BLACK FRIDAY ORDERS INCLUDE ONE PARTICIPATION IN THE RAFFLE (ONE ORDER = 1 NUMBER).

5.- LIMITATIONS

PRIZE LIMITATIONS

The volume of prizes will be awarded by phases of fulfillment of this crowdfunding/campaign partners:

For each phase reached:

  • Phase 1: 10 bags
  • Phase 2: 50 bags
  • Phase 3: 90 bags
  • Phase 4: 150 bags
  • Total closing of objectives and MIRACLE MADE REALITY: 300 BAGS

The number of prizes will be proportional in the same way until 100% of the campaign is reached.

OTHER LIMITATIONS

If it becomes evident that any of the participants do not meet the requirements set forth in the Rules, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded under this Promotion.

The following persons are not eligible to participate in the Promotion: (i) Employees employed by any of the companies and other entities with legal personality linked to Labienhecha (ii) Individuals who participate directly or indirectly in the capital of Labienhecha (iii) Any other individual who has participated directly or indirectly in the organization of this Sweepstakes or has been involved directly or indirectly in its preparation or development (agency, suppliers, etc.).

The prize awarded will not be transferable or subject to changes, alterations or compensation at the request of the Participants, and cannot be exchanged for any other product or money.

Labienhecha reserves the right, in case of just cause and previous legal communication, to make any change, suspend or extend this Promotion.

The winner will be responsible for any fiscal or tributary charge that the acceptance of the prize could suppose, as well as any other expense derived from the promotion that is not expressly assumed by Labienhecha in the present Legal Bases (e.g.: shipping costs and customs taxes).

It is established a term of THIRTY (30) calendar days from the date of the awarding of the prize, to make any motivated claim. Labienhecha reserves, in case of necessity, the right to substitute the prize for another of similar characteristics.

The prize will be sent within 30 days (if the chosen model is available).

6.- PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory or that could violate the rights of third parties will not be allowed. Nor will be allowed comments against an individual that violate the principles of the right to honor, personal and family privacy and self-image. We will not be responsible for any damage caused by the comments made by the participants in the Promotion, and that at any time could hurt the sensitivity of other participants.

7.- DISCLAIMER OF LIABILITY

By way of example, but not limitation, we are not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the participant with respect to the prize obtained from this Promotion, and do not assume any responsibility for any damage or harm of any kind that may be suffered by the Participants, winner or third parties.

We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the realization of the Promotion or the total or partial enjoyment of the prize. In case this Promotion could not be carried out, either due to frauds detected in the same, technical errors, or any other reason not under Labienhecha's control and affecting the normal development of the Sweepstakes, we reserve the right to cancel, modify or suspend the same, including the participation web page.

8.- GOAL: FACEBOOK/INSTAGRAM OR OTHERS.

The promotion is not sponsored, endorsed, administered by, or associated in any way with Facebook/Instagram; therefore, Participants release META from all liability for any damages arising therefrom.

9.- PROTECTION OF PERSONAL DATA

Labienhecha takes very seriously the protection of your privacy and your personal data. Therefore, your personal information is kept securely and treated with the utmost care.

In accordance with the provisions of the applicable data protection regulations, and specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, each Participant, with the acceptance of these Legal Bases consents that the personal data provided for the participation in this contest will be incorporated into a file owned by Labienhecha Estudio SL to process the participation in the contest and to communicate the prize in case of being a Winner.

We inform you that your personal contact data will be used for the following purposes:

Participants guarantee that the personal data provided are truthful and are responsible for communicating to Labienhecha any modification thereof. Labienhecha reserves the right to exclude from this promotion any Participant who has provided false data. It is recommended to have the maximum diligence in Data Protection by using security tools, Labienhecha cannot be held responsible for illicit subtractions, modifications or loss of data.

Participants have the right to (i) access to their personal data, as well as to (ii) request the rectification of inaccurate data or, as the case may be, request its deletion, (iii) request the limitation of the processing of their data, (iv) oppose to the processing of their data and (v) request its portability. Without prejudice to any other administrative remedy or judicial action, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in case he/she considers that the processing of his/her personal data is not in compliance with the regulations, as well as in case he/she does not see the exercise of his/her rights satisfied.

The Control Authority to which the complaint has been submitted will inform the complainant about the course and outcome of the complaint.

10.- CHANGES

We reserve the right to modify or extend these promotional bases, as long as it does not prejudice or undermine the rights of the participants in the Promotion.

11.- APPLICABLE LAW AND JURISDICTION

These legal bases shall be governed in accordance with Spanish law. The Courts and Tribunals of the city of Malaga will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or fulfillment of these rules.
